Practitioner understanding and adherence to the General Data Protection Regulation (GDPR), as well as global privacy regulations where appropriate, is essential for maintaining client confidentiality and trust.

This article explores and advises some key principles to ensure the appropriate use of personal data and compliance.

Personal data vs special category data vs PII

Personal data refers to any information relating to an identified or identifiable individual. This includes, but is not limited to, names, addresses, contact details and sensitive information such as health records.

The GDPR distinguishes between personal data and ‘special category’ data. A list of ‘special category’ data can be found here. Special category data warrants heightened protection due to its sensitive nature, and Unmind ensures that all clients explicitly consent to sharing their health and wellbeing data when creating their Unmind account.

All personally identifiable information (PII) comprises of personal data. An example of personal data which does not classify as PII is an individual’s IP address. This is still protected under GDPR as it can be attributed to a single individual.

Using personal data appropriately

Here are some tips to ensure personal data is treated and used appropriately at all times:

  • Storage and access: Refrain from retaining identifiable client information unnecessarily. Ensure that any digitally stored information is securely encrypted and accessible only to authorised personnel. Please also see Unmind’s article on storing session notes.
  • Emailing: Avoid including personal data in the subject and body of a message. Instead, use the client’s initials or codes to maintain anonymity and protect confidentiality.
  • Consider global regulations: When working with clients overseas or transferring data internationally, be aware of any additional regulations that may apply. Ensure that data transfers comply with GDPR standards and consider additional measures to safeguard information.
